Agreement to Terms

By accessing or using Competrace ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

Description of Service

Competrace is a competence-tracking platform that helps teams manage and develop employee skills and competencies. We reserve the right to modify, suspend, or discontinue the Service at any time.

Account Responsibilities

When you create an account, you agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or its infrastructure
  • Scrape, crawl, or use automated tools to access the Service without permission
  • Impersonate others or misrepresent your affiliation
  • Upload malicious code or content

Intellectual Property

The Service, including its design, features, and content, is owned by Competrace and protected by intellectual property laws. You retain ownership of any data you submit to the Service. By using the Service, you grant us a limited license to process your data solely to provide the Service.

Data Processing

Where we process personal data on your behalf (such as your employees' evaluation data), we act as your processor under our Data Processing Agreement, which is incorporated into these Terms by reference. How we handle personal data is described in our Privacy Policy.

Subscriptions, Billing, and Refunds

Competrace is offered on two plans:

  • Free — $0, for organizations with up to 10 members.
  • Team — $50 per month, including up to 50 members, plus $0.50 per month for each additional member beyond 50.

All prices, including the per-member charge for additional members, are exclusive of tax. Paddle calculates the VAT or sales tax for your country and adds it on top, both at checkout and on every renewal. If you have a VAT registration number, you can enter it at checkout and Paddle will apply the treatment required in your country. The Team plan is billed monthly and renews automatically at the start of each billing period until canceled.

Payments are processed by Paddle.com Market Ltd ("Paddle"), our authorized reseller and Merchant of Record. Paddle handles payment processing, the collection and remittance of sales tax and VAT, and the issuing of invoices and receipts. Paddle — not Competrace — appears on your card statement and is the entity that issues your receipts. Your payment card details are handled entirely by Paddle; Competrace never receives or stores your full card number.

You may cancel at any time from Settings. Cancellation takes effect at the end of your current paid billing period. Your organization keeps Team access until then and reverts to the Free plan afterward. Payments are non-refundable, and we do not provide refunds or credits for partial billing periods, except where required by law.

If a payment fails, Paddle will automatically retry the charge and notify you by email. Your Team access continues during a short grace period while payment is attempted. If payment cannot be recovered, the subscription is canceled and your organization reverts to the Free plan.

We may change our pricing from time to time. We will give you advance notice of any price change by email or through the platform, and changes will not affect the billing period already in progress.

Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Your organization controls your membership: an administrator may remove you at any time, which permanently and irreversibly deletes your membership and the evaluation records about you, and deletes your account once you no longer belong to any organization. You may address deletion requests to your organization's administrator, or to us at support@competrace.com. Upon termination, your right to use the Service ceases immediately.

Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

Limitation of Liability

To the maximum extent permitted by law, Competrace shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Service.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the European Union. Any disputes arising from these Terms or the Service shall be resolved in the courts of the applicable jurisdiction.

Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by email or through the platform. Continued use of the Service after changes constitutes acceptance of the new Terms.
